旨揭公保法第 10 條及第 36 條修正條文分別自 112 年 12 月 17 日及 113 年 1 月 5 日生效，請各機關（構）學校依修正後公保法第 36 條規定辦理下列事項：
(一)公教人員保險（以下簡稱公保）被保險人於符合下列條件之一，且未曾請領相關社會保險生育給付或全國軍公教員工待遇支給要點所定之生育補助（以下簡稱軍公教生育補助），即得請領公保生育給付：
１、在公保有效加保期間分娩或早產。
２、在公保有效加保期間懷孕，且於退出公保後 1 年內，因同一懷孕事故而分娩或早產。
(二)前開所稱 1 年內因同一懷孕事故而分娩或早產之起算基準日，應自被保險人退出公保之日起算，並以退出公保前 1 日起往前推算 6 個月保險俸（薪）額之平均數計給公保生育給付。
(三)公保被保險人於 103 年 6 月 1 日起至 113 年 1 月 4 日公保法第 36 條規定修正生效前期間內，如符合前開修正後之公保生育給付法定請領要件之一，且被保險人本人未曾因同一分娩或早產事實領取公保、相關社會保險生育給付或軍公教生育補助者，得自 113 年 1 月 5 日修正生效之日起 10 年內向承保機關提出申請公保生育給付，並依被保險人分娩或早產時之給與標準發給。

(四)為應本次公保法修正施行，公保部業配合修訂報送實務作業規定、請領書、增修現金給付業務 Q&A 、保險權利義務等修法相關資訊供參，請逕至本行全球資訊網(網址： https://www.bot.com.tw)「政策性業務」之『公保服務』項下載參閱，嗣後請以修訂後之書表及報送實務作業規定辦理公保業務，並請廣為宣導週知。如有公保業務任何疑義，請逕電洽本部相關科辦理(總機： 02-27013411)。↵
